This Terms and Conditions Agreement (“Agreement”) sets forth the legally binding terms for your use of the Services provided by MYBOOK.ARCHI. By using the Services, you agree to be bound by this Agreement, whether you are a “Visitor” (which means that you simply browse the Website or App) or you are a “Member” (which means that you have registered with MYBOOK.ARCHI and set up an Account). The term “User” refers to a Visitor or a Member. You represent and warrant that you are authorized to enter into this Agreement on behalf of yourself and/or the entity that you purport to represent.

1. Eligibility. By using the Services, you represent and warrant that: (a) all required registration information you submit is truthful and accurate; (b) you will maintain the accuracy of such information.

2. Term. This Agreement shall remain in full force and effect while you use the Services or are a Member. You may delete your Account and end your membership at any time, for any reason by following the instructions on the “My MYBOOK.ARCHI Account” page. MYBOOK.ARCHI MAY TERMINATE YOUR MEMBERSHIP AT ANY TIME AND FOR ANY REASON, EFFECTIVE UPON SENDING NOTICE TO YOU AT THE THEN-CURRENT E-MAIL ADDRESS IN YOUR ACCOUNT PROFILE.

3. Password. When you sign up to become a Member, you will also be asked to choose a username and a password. You are entirely responsible for maintaining the confidentiality of your password. You agree not to use the Account, username, or password of another Member at any time. You agree to notify MYBOOK.ARCHI immediately if you suspect any unauthorized use of your Account or access to your password. You are solely responsible for any and all use of your Account.

4. Your Book Content.
4.1 Definitions. “Content” includes text, files, design templates, images, photos, works of authorship, and other material. Your “Book Content” includes Content that you include in the Books, submit to MYBOOK.ARCHI for Books and print services. MYBOOK.ARCHI HAS NO OWNERSHIP OF ANY OF YOUR BOOK CONTENT.
4.2 Ownership of Your Book Content. You represent and warrant that: (i) you own or otherwise have the right to grant the licenses set forth in this section for the Book Content that you provide to and post on the Services or provide for our print services to have them printed in a Book, and (ii) your Book Content does not violate the privacy rights, publicity rights, copyright rights, or other rights of any person or entity.

5. License. In order for MYBOOK.ARCHI to be able to provide you with their Services, you hereby agree to provide MYBOOK.ARCHI with the following licenses to use your Book Content:
5.1 License to print your Books. You hereby grant to MYBOOK.ARCHI a non-exclusive, worldwide, fully-paid and royalty-free license (a “License”) to reproduce your Book Content for the purpose of printing the Books that you order, and for any other related purpose that you authorize. You agree that MYBOOK.ARCHI reserves the right to maintain the electronic files for any Book(s) to fulfill any further orders which may be placed for such Book(s) and to maintain an archival copy of the printed Book.
5.2 License to use your Book Content for optional MYBOOK.ARCHI promotional activities. You hereby grant MYBOOK.ARCHI a License to reproduce, distribute, publicly display, use, and otherwise make available the designated Book(s), any Book Content therein, and any other data and information you provide in connection with your order, for promotional purposes pertaining to the services provided by MYBOOK.ARCHi.

6. Your Content and Activity. You are solely responsible for any and all Book Content and Other Content that is posted by or through your Account on any Services (including any Content that you may have received by third parties) including any e-mail, or included in Books submitted by you. You agree that MYBOOK.ARCHI retains the right to create limits on MYBOOK.ARCHI’s archiving of such data, including but not limited to the right to delete such data after a certain period without a purchase or to charge for extended storage of such data.

7. ISBN Numbers; Publisher Status. MYBOOK.ARCHI may provide features that permit you to include an International Standard Book Number (“ISBN”) with your Book. Depending on the features, you may be permitted to acquire an ISBN through MYBOOK.ARCHI or provide your own ISBN for inclusion in your Book. YOU ACKNOWLEDGE AND AGREE THAT, NOTWITHSTANDING THE METHOD YOU USE TO OBTAIN AN ISBN FOR YOUR BOOK(S), MYBOOK.ARCHI IS NOT THE PUBLISHER OF YOUR BOOKS (INCLUDING YOUR BOOK CONTENT) AND YOU WILL NOT STATE OR OTHERWISE SUGGEST THAT MYBOOK.ARCHI IS THE PUBLISHER OF YOUR BOOKS. YOU REPRESENT AND WARRANT THAT YOU ARE THE PUBLISHER OF YOUR BOOK(S) (INCLUDING YOUR BOOK CONTENT) AND, IN ANY CASE, THAT YOU BEAR THE FULL AND ULTIMATE RESPONSIBILITY FOR THE PUBLICATION AND DISTRIBUTION OF YOUR BOOKS (INCLUDING YOUR BOOK CONTENT).

8. Limited Warranty for Books. MYBOOK.ARCHI warrants that, subject to minor differences across products and printing partners as described in MYBOOK.ARCHI’s Return Policy available at http://www.MYBOOK.ARCHI.. Books will be free of any material defects in materials and workmanship. MYBOOK.ARCHI will, at its own expense and at its sole obligation and your exclusive remedy, replace any materially defective Books which you report to MYBOOK.ARCHI via MYBOOK.ARCHI’s Order Support within fourteen (14) days of your receipt thereof in accordance with the Return Policy.

9. Electronic communications. The communications between you and MYBOOK.ARCHI use electronic means, whether you visit the Website otherwise use the Service or send MYBOOK.ARCHI e-mails, or whether MYBOOK.ARCHI posts notices on the Website or communicates with you via e-mail. For contractual purposes, you (a) consent to receive communications from MYBOOK.ARCHI in an electronic form; and (b) agree that all terms and conditions, agreements, notices, disclosures, and other communications that MYBOOK.ARCHI provides to you electronically satisfy any legal requirement that such communications would satisfy if it were be in writing. The foregoing does not affect your statutory rights.

10. Copyright/Trademark Information. Copyright © 2017, MYBOOK.ARCHI. All rights reserved. The trademarks, logos and service marks (“Marks”) displayed on the Website or in connection with the Services are the property of MYBOOK.ARCHI or other third parties. You are not permitted to use these Marks without the prior written consent of the third party that owns the Mark.

Payment & shipping

1. Fees.
You acknowledge that MYBOOK.ARCHI reserves the right to charge for Services and occasionally change fees at its discretion, upon posting said change by on the MYBOOK.ARCHI official Website. By using the Services, you will be responsible for the payment of any applicable fees to MYBOOK.ARCHI, as detailed on the MYBOOK.ARCHI official Website.

2. Payment
On the MYBOOK.ARCHI official Website you will be directed to different payment options. To subscribe to these services, the user must enter the requested data. Approval of purchase can take up to several minutes. The user pledges to not engage in fraudulent transactions. Unlawful or otherwise fraudulent transactions shall be immediately communicated to relevant lawful authorities.
A) Payment by credit card This service is provided by Banco BBVA system. Any operation associated with your Credit Card is made directly between the card holder and Banco BBVA, and processed directly by this entity, therefore MYBOOK.ARCHI does not have access to any pertinent data on the aforementioned credit card. MYBOOK.ARCHI does not receive or store any data pertaining to any Credit Cards involved in these transactions; payments and corresponding data are managed by the banking entities.
B) Payment by PayPal Services can be purchased through PayPal. All relevant data will shared directly between the user and PayPal. This service holds a transaction fee of € 0.90

**All photographs provided become property of the client. MYBOOK.ARCHI holds a copy of all photographs for work purposes.

4. Fees and Charges.
You agree to pay all fees and charges incurred in connection with your orders and purchases. When you order Books or other products for overseas delivery, you may be subject to import duties and taxes, which are levied upon arrival of the package containing the Books and products at the destination that specified by the client. Any customs clearance fees (if any) shall be charged to the client; MYBOOK.ARCHI does not determine nor interfere with such charges. Customs policies vary from country to country; MYBOOK.ARCHI suggests the client contact the customs offices at their location for more information, and reminds the client they are considered the sole importer and must comply with all laws and regulations pertaining to their country, state, city, or location.

5. Order acceptance policy.
Your receipt of an electronic or other form of order confirmation does not signify MYBOOK.ARCHI’s acceptance of your order, nor does it constitute confirmation of sale. MYBOOK.ARCHI reserves the right at any time after receipt of your order to accept or decline your order for any reason. Your order will be deemed accepted by MYBOOK.ARCHI upon our delivery of the products that you have ordered. We may require additional verifications or information before accepting any order.

6. Title and Risk of Loss.
All sales of Books and other products are made FOB shipping agent.  Title and risk of loss to each shipment of the Books and other products shall pass to you upon transfer to the shipping agent, FOB

MYBOOK.ARCHI, is a trademark of AVANTIADESIGN, located at rua Bernardim Ribeiro, 141, 2715-258 Almargem do Bispo, Sintra Portugal, (“MYBOOK.ARCHI”, “us” or “we”) and respects the privacy of the visitors to its Website located at http://www.MYBOOK. ARCHI.com (the “Website”), and users of its Services. This Privacy Policy informs you of our policies and practices regarding the collection, use, storage and disclosure of any Personal Information and Anonymous Information you submit to us through the Website or other Services. It also describes your choices regarding use, access and correction of your personal information. The use of information collected through our service shall be limited to the purpose of providing the service for which the Client has engaged MYBOOK.ARCHI.

Contact us
Should you have any questions or concerns regarding this Privacy Policy, please contact us through Customer Support Return Policy for Printed Books. On the off chance your printed book arrives damaged, with a material manufacturing defect, or a material defect in workmanship, contact us via MYBOOK.ARCHI within 14 days of receipt and we will work with you to secure a replacement copy if necessary. Please note that each printed book you order from us is individually made by one of MYBOOK.ARCHI professional book-printing partners. There may be minor differences across different prints of the same books and/or across books printed by our different book-printing partners, including, but not limited to, slight variances in color fidelity and binding type. While we work very hard to keep our product as consistent as possible, this variation is a normal occurrence and is not considered a manufacturing defect or a defect in workmanship and does not qualify for a reprint
